Debt Collection


Debt Collection relates to the recovery of accounts outstanding. The Courts, in recognition of the fact that frequently debtors have no reason to contest the validity of the claim of the creditor other than their inability or unwillingness to pay, devised a special Summary procedure to deal with such claims. Summary meaning without resort to a formal court hearing unless there is a dispute in relation to the amount of the claim or the quality of the work done. Therefore, the procedure is entirely documentary and judgement is obtained in the office of the Clerk of the Court on foot of and Affidavit of the Creditor.

We operate a hierarchy of courts in Ireland, with each court having a financial limit. Each Court has its own procedure for obtaining summary judgement.

District Court €1.00 to €6,348.00
Circuit Court €6,349.00 to €38,092.00
High Court €38,093.00 upwards

The processes are extremely bureaucratic and protracted. The biggest difficulty is keeping track of the process and ensuring that it is proceeded expeditiously. We have an automated computerised procedure which makes management of the system reasonably easy.

If the debt is disputed, than the process reverts to an ordinary court hearing in front of a judge.
